日本学術振興会, 科学研究費助成事業 基盤研究(C), 環境条約のガバナンス機能の正当性及び実効性の要因分析と再構築, 20210401, 20240331, 遠井 朗子; 眞田 康弘, スタートアップ企画等は、諸事情により実施することができなかったが、関連業績において、以下の点を明らかにした。
CITESは絶滅が危惧される野生動植物種の過度な利用を防止するため、その国際取引を規制する条約であるが、利用を一律に禁止するわけではなく、保存と利用のバランスは当初より論争の的であった。1990年代以降、希少な野生生物を自国の戦略的資源と位置付けて活発な交渉を展開してきた原産国の主張が認められ、「持続可能な利用」の主流化が図られて、取引量が増大し、精緻な実施メカニズムが構築されてきた。
しかし、近年、利用に伴うリスクを勘案し、利用を制限する方向へと論調が再び変化している。第一に、国際的な評価報告書、政策文書等においては、生物多様性の損失が人類の存立基盤を脅かすおそれのある重大な社会経済リスクとなるとの認識が共有される一方で、これまでの国際的取組みは十分な成果を上げていないとの評価が確立していることを指摘した。このような危機認識の高まりを背景として、CITESにおいても利用の推進を見直して、厳格な管理が正当化される可能性がある。この状況の下、ニホンウナギについては、資源量の枯渇が科学的に認められているため、仮に附属書掲載提案がなされた場合、採択される可能性は高いことを指摘した。第二に、新型コロナウィルス感染症のパンデミックを契機として、種の保全、動物福祉、人の健康、生態系保全の統合を提言するOne Health/One Welfareアプローチが注目を集めている。CITESにおいても、従来の規制基準・手順とは異なる方法で生きた野生動物の取引に厳格な条件を付し、実質的に取引禁止の効果をもたらす決定が採択された経緯を、統合アプローチの受容という観点から評価し、この点からみた日本の国内実施の課題についても指摘した。 Japan Society for the Promotion of Science, Grants-in-Aid for Scientific Research Grant-in-Aid for Scientific Research (C), グローバルな視点からの日本の環境影響評価制度の再検討ー「国際標準」との差異の分析, 201704, 202003, 増沢 陽子; 久保 はるか; 遠井 朗子; 児矢野 マリ, 2018年度はまず、前年度の検討を基に、環境影響評価（EIA)制度に係る国際標準の同定のための枠組みを作成した。すなわち、EIAに関し多数国間条約体制及び／又は多くの先進国が採用している制度・考え方等を「国際標準」と捉え、現在の日本のEIA制度において課題と考えられるいくつかの視点・側面について、国際法・規範及び他の国地域の国内（域内）法上の制度等の状況を調査するとともに、日本との比較を行うこととした。「他の国地域」としては、関係国の数や地理的な分布等を考え、米国、EU及びニュージーランドを中心とした。なお、本科研研究においては、研究対象とする「EIA制度」を、政府の意思決定に関連して環境への影響を評価する制度を広く含むものと考えている。
この枠組によりメンバーで分担して調査を行い、その結果を10月に開催した研究会においてそれぞれ報告し、議論を行った。この調査・検討を踏まえて、垂直的・水平的な国際比較から見た日本のEIA制度の特徴やその背景について、2019年4-5月に開催される国際影響評価学会（IAIA）の年次大会（IAIA19）において報告を行うこととし、その申込みが受理された。

However, presumably it is not always easy due to various factors. The project, a multi-disciplinary study of public international law, administrative law, public administration and environmental law and policy, aims to find some good ways to deal with the problems. It has conducted comprehensive research on Japanese practice for implementing multilateral environmental agreements and on impact of Japanese law and policy on their negotiation process from various viewpoints. Based on the thorough analysis of six main fields of environmental issues, such as climate change, ozone depletion, marine pollution, management of hazardous wastes or chemicals, biological diversity and nuclear safety, the strength and weakness of Japanese practice has been identified. The problems and future prospects have been examined as well. We couldn't find, however, sufficient accumulation of state practices to prove the structural conversion of state-centered international law.
Our research also has shown that some local and national administrative bodies referred to UN declaration and occasionally used it to justify their policies concerning the Ainu. At municipal level, however, this tendency can be seen only in a few local areas where relatively many Ainu people live. | 日本学術振興会, 科学研究費助成事業 基盤研究(C), 環境条約のガバナンス機能の正当性及び実効性の要因分析と再構築, 20210401, 20240331, 遠井 朗子; 眞田 康弘, スタートアップ企画等は、諸事情により実施することができなかったが、関連業績において、以下の点を明らかにした。 CITESは絶滅が危惧される野生動植物種の過度な利用を防止するため、その国際取引を規制する条約であるが、利用を一律に禁止するわけではなく、保存と利用のバランスは当初より論争の的であった。1990年代以降、希少な野生生物を自国の戦略的資源と位置付けて活発な交渉を展開してきた原産国の主張が認められ、「持続可能な利用」の主流化が図られて、取引量が増大し、精緻な実施メカニズムが構築されてきた。 しかし、近年、利用に伴うリスクを勘案し、利用を制限する方向へと論調が再び変化している。第一に、国際的な評価報告書、政策文書等においては、生物多様性の損失が人類の存立基盤を脅かすおそれのある重大な社会経済リスクとなるとの認識が共有される一方で、これまでの国際的取組みは十分な成果を上げていないとの評価が確立していることを指摘した。このような危機認識の高まりを背景として、CITESにおいても利用の推進を見直して、厳格な管理が正当化される可能性がある。この状況の下、ニホンウナギについては、資源量の枯渇が科学的に認められているため、仮に附属書掲載提案がなされた場合、採択される可能性は高いことを指摘した。第二に、新型コロナウィルス感染症のパンデミックを契機として、種の保全、動物福祉、人の健康、生態系保全の統合を提言するOne Health/One Welfareアプローチが注目を集めている。CITESにおいても、従来の規制基準・手順とは異なる方法で生きた野生動物の取引に厳格な条件を付し、実質的に取引禁止の効果をもたらす決定が採択された経緯を、統合アプローチの受容という観点から評価し、この点からみた日本の国内実施の課題についても指摘した。 |
| Japan Society for the Promotion of Science, Grants-in-Aid for Scientific Research Grant-in-Aid for Scientific Research (C), グローバルな視点からの日本の環境影響評価制度の再検討ー「国際標準」との差異の分析, 201704, 202003, 増沢 陽子; 久保 はるか; 遠井 朗子; 児矢野 マリ, 2018年度はまず、前年度の検討を基に、環境影響評価（EIA)制度に係る国際標準の同定のための枠組みを作成した。すなわち、EIAに関し多数国間条約体制及び／又は多くの先進国が採用している制度・考え方等を「国際標準」と捉え、現在の日本のEIA制度において課題と考えられるいくつかの視点・側面について、国際法・規範及び他の国地域の国内（域内）法上の制度等の状況を調査するとともに、日本との比較を行うこととした。「他の国地域」としては、関係国の数や地理的な分布等を考え、米国、EU及びニュージーランドを中心とした。なお、本科研研究においては、研究対象とする「EIA制度」を、政府の意思決定に関連して環境への影響を評価する制度を広く含むものと考えている。 この枠組によりメンバーで分担して調査を行い、その結果を10月に開催した研究会においてそれぞれ報告し、議論を行った。この調査・検討を踏まえて、垂直的・水平的な国際比較から見た日本のEIA制度の特徴やその背景について、2019年4-5月に開催される国際影響評価学会（IAIA）の年次大会（IAIA19）において報告を行うこととし、その申込みが受理された。 以上の全体的な比較研究と並行して、EIA制度の国際的な発展の最新の状況を把握する等のため、2019年2月に開催されたUNECE越境EIA条約（エスポー条約）締約国会合に参加し、情報収集・実務専門家との意見交換等を行った。また、EIA制度の一形態ともいいうるEUの影響評価（IA)制度について、調査を進めた。 |

However, presumably it is not always easy due to various factors. The project, a multi-disciplinary study of public international law, administrative law, public administration and environmental law and policy, aims to find some good ways to deal with the problems. It has conducted comprehensive research on Japanese practice for implementing multilateral environmental agreements and on impact of Japanese law and policy on their negotiation process from various viewpoints. Based on the thorough analysis of six main fields of environmental issues, such as climate change, ozone depletion, marine pollution, management of hazardous wastes or chemicals, biological diversity and nuclear safety, the strength and weakness of Japanese practice has been identified. The problems and future prospects have been examined as well. |

We couldn't find, however, sufficient accumulation of state practices to prove the structural conversion of state-centered international law. Our research also has shown that some local and national administrative bodies referred to UN declaration and occasionally used it to justify their policies concerning the Ainu. At municipal level, however, this tendency can be seen only in a few local areas where relatively many Ainu people live. Besides, there is no case where the UN declaration fundamentally changed the existing national and local policies toward the Ainu. |
